Placing an Order

To request a quote or place an order, kindly correspond with us at inquiries@refractory.studio with your name, location, and piece of interest as well as any pertinent details you can provide.

Please let us know at this time if you are a member of the trade. 

Upon your receipt of your inquiry, an associate will work with you on quoting and servicing your project.

Where Refractory works are made

Refractory pieces are patterned, moulded, cast, fabricated, and finished by hand in Chicago at Refractory's sister company and production atelier West Supply, as well as by other local artisans and producers in different materialities. 

Customization & Commissions

Many Refractory works are conceived to be customizable and tailored as one of a kind works for any installation.  Customization can be by way of form, scale, application and/or patination.

Refractory is open to considering product, sculpture, and architectural application commissions. 

 

Custom Finish and Patina

Regarding custom finishes and patination, Refractory will request a photograph and/or sample to consider in order to develop a patina sample for your consideration.  This master sample may currently require 20-30 days to produce.  

 

Collaboration

Central to Refractory's intent is supporting a platform for collaboration.  We are open to creative partnerships, commissions and special projects in the realms of custom furnishings for residential or commerical applications, small and civic scale sculpture, lighting, cast tile, interior architectural elements, bronze doors, monumental hardware and lighting of most any kind.

Lead times may vary considerably depending on stock or raw material availability, product complexity, customization etc.

Shipping & Delivery

 

Shipping

Refractory will provide shipping quotes for you during the ordering process.  

 

Receiving

Either a qualified receiving warehouse or qualified receiving person should be present to accept products upon delivery.  A receiving warehouse acts as the client's agent. It is responsible for noting any damage and assisting the owner with filing a freight claim when any damage is found.  We highly recommend using a qualified receiving warehouse to receive, inspect, consolidate deliveries and facilitate installation.  A qualified receiving person should also be present to accept delivery when products are delivered directly to a home or installation site.  A receiving person will act as client's agent and is responsible for noting damage and assisting with filing a freight claim if any damage is found.

 

Signing for the shipment upon delivery

When receiving shipments with a BOL (Bill of Lading), a signature on the BOL confirms that the products were received in good condition unless an exception is made on the BOL. If the driver must must drop the shipment and depart, the receiver should note on the BOL that any concealed damage of boxed or crated items will be the responsibility of the carrier or the manufacturer, as determined upon inspection of the product. Full inspection must occur within 48 hours of delivery and, if applicable, all freight claims must be filed within 72 hours.

Small Parcel: When receiving parcel deliveries, a signature on carrier’s automated handheld device confirms that the products are received in good condition.

If the merchandise is refused upon delivery for quality or damage issues, the receiver should promptly contact Refractory.

Care & Maintenance

 

Metalworks

Bronze is an alloy with high copper content and will age over time. The beauty of bronze is in its endurance, ability to be restored and refinished for hundreds and thousands of years as needed. Refractory bronze works are sealed in an archival fashion to help to moderate oxidation. The patination process creates colors and nuance, while lacquers and waxes will protect the surface to a reasonable extent. It is normal for a work in bronze to slowly signs of subtle oxidation. This may be the result of geographic location as well as how often the piece is touched and handled.

For works in bronze, dust regularly with a soft, dry cloth and as needed clean with warm water on a soft cloth. Promptly dry with a fresh soft cloth. Cleaning solutions with detergents, alcohol, and solvents or commercial metal polishing agents and waxes may damage patination and other surface treatments.

If a surface or patina needs to be refreshed, a professional metal finisher and/or patineur should be consulted.

 

Glassworks

Cast and blown glass should be cleaned with a soft, damp cloth or a glass cleaning solution that contains no additives. Always apply cleaner to the soft cloth rather than directly to the glass surface in order to avoid over-spray.

 

Lighting

Metal finishes are susceptible to tarnish, pitting, and patina oxidation over time. Clean with a soft, drycloth. Do not use commercial cleaning products or solutions or wrap light fixtures in any form of plastic.

 

Wood

Wood pieces have been stained and/or polished to bring depth and beauty to each finish. Although most are protected with a clear sealer coat or wax, finishes are still susceptible to wear. Finish coats vary from piece to piece.

Care for wood pieces by dusting regularly with a dry, soft cloth. To remove occasional soil build-up, andonly when necessary, use a soft cloth moistened with warm water. Quickly dry the surface with a clean,dry cloth and remove any moisture. A mild solution of gentle soap and warm water can be used in cases of soiling.

Do not use commercial cleansers, detergents, or ammonia-based cleaners, and to avoid yellowing, do not use paste wax, oils, or aerosol products. To prevent drying and cracking as can happen over time,particularly with solid wood, it is recommend to avoid extreme changes in humidity.

Do not place hot or wet objects or rubber directly on wood surfaces, as damage may result. Exposure to direct sunlight will cause wood discoloration over time. To avoid marks and indentations, do not write directly on the wood surface without something in between as a barrier.

Finishes are not guaranteed against color fading from sun exposure or atmospheric conditions.

 

Stone

Stone is a natural material, markings and color will vary. Stone tops are sealed or polished to be stain resistant. Clean stone surfaces with a soft cloth and a few drops of stone soap or a light detergent combined withwarm water.

Too much cleaner or soap may leave a film or cause streaks. Rinse the surface thoroughly after cleaning and dry with a soft cloth. For spills, blot with a soft cloth immediately to prevent the stain from being absorbed by the stone.

Flush with water and mild soap and rinse well. Dry the area with a soft cloth.
It is recommend that stained or soiled stone be professionally cleaned by a stone cleaner or a re-finisher

Many common foods and beverages contain acids that will etch or dull the surface of many stones. Useplacemats or felt spots under china, ceramics, silver, or any other objects that may scratch the surface.

 

Polymers

Polymer pieces have been stained and/or polished to bring depth and beauty to each finish. Although most are protected with a clear sealer coat or wax, finishes are susceptible to wear. Finishes vary from piece to piece.

Care for polymer pieces by dusting regularly with a dry, soft cloth. To remove occasional soil build-up, and only when necessary, use a soft cloth moistened with warm water. Quickly dry the surface with a clean, dry cloth and remove any moisture. A mild solution of gentle soap and warm water can be used in
cases of soiling.

Terms & Conditions

Orders Subject to Acceptance

All Orders are subject to acceptance by Refractory (“we” or “Refractory”).

Acceptance of orders is based on the express condition that the Buyer (“buyer” or “you”) agrees to all of the terms and conditions contained herein. Acceptance of delivery by Buyer will constitute Buyer’s assent to these terms and conditions. These terms and conditions represent the complete agreement of the parties, and no terms or conditions in any way adding to, modifying, or otherwise changing the provisions stated herein shall be binding upon Refractory unless made in writing, and signed and approved by an officer of Refractory. No modification of any of these terms will be affected by Refractory’s shipment of goods following receipt of Buyer’s purchase order, shipping request, or similar forms containing printed terms and conditions conflicting or inconsistent with the terms herein.  


Prices & Terms

Refractory orders must be in the form of a legally binding purchase order with item name, applicable SKUs, quantity, finish, requested delivery date, and pricing. Refractory welcomes custom orders and will proceed upon customer approvals of samples, drawings, pricing, delivery and payment terms.

Prices are subject to change without notice. All product prices are exclusive of other charges as well as packaging and freight charges. All prices are FOB from Refractory’s workshop in Chicago, Illinois. Product pricing does not include shipping, storage, local delivery, cartoning, crating, packing, sales tax, or uncrating. These services may be quoted as separate line items. All prices are in US Dollars.

A deposit of fifty percent (50%) of the total purchase price is required to initiate order fulfillment. All accounts shall be paid net when invoiced. Orders for in stock products require payment in full at the time of order placement.  A service charge of the lesser of 2% per month or the maximum permissible rate will be added to all accounts not paid within sixty (60) days from the date of invoice for final balance due. Orders must be paid in full, including any applicable or prescribed shipping, handling, crating and packing, storage (see “STORAGE”), taxes, and service charges prior to shipping or retrieval from Refractory.

All taxes and excises of any nature whatsoever now or hereafter levied by governmental authority, whether federal, state or local, either directly or indirectly, upon the sale or transportation of any goods covered hereby shall be paid and borne by Buyer.


Method of Shipment

Refractory will arrange product shipments unless Buyer specifies the shipment method.  Any shipments returned to Refractory as a result of Buyer’s unexcused delay or failure to accept delivery will require Buyer to pay all additional costs incurred by Refractory including Storage fees.


Storage Fees

All orders will be shipped upon competition and final payment. Items not picked up within 60 days from the date of invoice for final balance due will be subject to storage and handling fees of 3% of order value per month. No order will be released until storage fees have been paid.


Order Cancellations & Returns

Orders may not be cancelled after ten (10) business days after deposit is received or purchase order accepted by Refractory. After ten (10) business days, any deposit made by Buyer in connection with an order is nonrefundable and may be applied to a future new order within ninety (90) days. Cancellations and changes require prior written approval and confirmation from Refractory.  Such orders may be subject to change, cancellation or stocking fees up to 50% of the net selling prices.  Special orders are not returnable.


Force Majuere 

All quoted completion and delivery dates are estimates only. Refractory shall not be liable for delays in completion or shipment, or default in delivery for any reason of force majeure or for any cause beyond Refractory’s reasonable control including, but not limited to: (a) government action, war, riots, civil commotion, embargoes, or martial law; (b) Refractory’s inability to obtain necessary materials from its usual sources of supply; (c) shortage of labor, raw material, production or transportation facilities or other delays in transit; (d) labor difficulty involving employees of Refractory or others; (e) weather events, fire, flood, or other casualty, or (f) other contingencies of manufacture or shipment. In the event of any delay in Refractory’s performance due in whole or in part to any cause beyond Refractory’s reasonable control, Refractory shall have such additional time for performance as may be reasonably necessary under the circumstances. Acceptance by Buyer of any goods shall constitute a waiver by Buyer of any claim for damages on account of any delay in delivery of such goods.


Title / Risk of Loss

Delivery of goods to the carrier shall be deemed delivery to Buyer, and thereupon title to such goods, and risk of loss or damage, shall be Buyer's. Any claim by Buyer against Refractory or carrier for shortage or damage occurring prior to such delivery must be made in writing within forty-eight (48) hours after receipt of shipment and accompanied by original transportation bill signed by the carrier noting that the carrier received the goods from Refractory in the conditions claimed.


Disclaimer

Finishes are applied by hand and may vary in color, tone, and character. While Refractory will make reasonable efforts to match a finish, no guarantee can be made of an exact match. Refractory does not guarantee finishes against fading or oxidizing.  Variations in color, grain, textures are inherent within natural resources (cast bronze, cast glass, cast resin, stone and wood) and are considered to be part of the material’s natural beauty and evidence of craft.  Items manufactured by Refractory are handmade and therefore subject to slight variations.

 

Warranty

Refractory warrants its furniture to be free from defects in workmanship and materials.  Product carries a one (1) year warranty from date of completion.  This warranty does not apply to damage or breakage resulting from misuse, accidents, abuse, neglect, mishandling or wear resulting from normal use.  Defective product will be repaired or replaced at Refractory's discretion.  This warranty does not cover variation or defects in bronze, fabric, leather, resin, stone and the changing nature of patinas.

Many woods and metal finishes are applied by hand and may vary slightly in color, tone and character.  Refractory will make every effort to match a finish, however, no guarantee can be made of an exact match.  Refractory does not guarantee against fading and oxidizing.  Variations in color and veining are inherent in stone, wood, fabric, and leathers.  All Refractory furniture is handmade and is therefore subject to slight variation.

Limitations of Liability

Refractory shall not be liable for special, punitive, incidental or consequential losses, damages or expenses, directly or indirectly arising from the manufacture, sale, handling or use of any goods, or from any other cause with respect to the services or goods of, or obtained by Refractory, whether such claim is based upon breach of contract, breach of warranty, strict liability in tort, negligence or any other legal theory. Further, in no event shall the Refractory be liable for any damages or other amounts for any reason whatsoever in excess of the purchase price of the goods and services ordered by Buyer. 

Any claim by Buyer with reference to the goods sold hereunder for any cause shall be deemed waived by Buyer unless submitted to Refractory in writing within forty-eight (48) hours from the date Buyer discovered, or should have discovered, any claimed breach.


Remedies upon Default

Refractory requires payment for any shipment hereunder in advance. If Buyer fails to make payment in accordance with the terms of this agreement or otherwise fails to comply with any provision hereof, Refractory may, at its option, cancel any unshipped portion of this order, retain the goods, and declare a forfeiture of the deposit as liquidated damages.


Exclusions

All of Refractory’s drawings, descriptive matter, weights, dimensions, descriptions, and illustrations contained in the Refractory’s website, catalogues, price lists, or advertisements are close approximations only and intended to give a general description of the goods, and shall not form part of this agreement. Furniture and lighting is handmade, therefore subject to variations. All sizes as indicated in the price list are within 1/2” variance.


Waiver

Waiver by Refractory of any breach of these terms and conditions shall not be construed as a waiver of any other breach, and failure to exercise any right arising from any default hereunder shall not be deemed a waiver of such right at any subsequent time. Any such waiver must be in writing and signed by an officer of Refractory.


Severability

In the event that any one or more of these terms or conditions is held invalid, illegal, or unenforceable, such provision or provisions shall be severed and the remaining terms and conditions shall remain binding and effective.


Modification

Refractory reserves the right to change, modify, or otherwise alter these Terms and Conditions, and its website, at any time and at its sole discretion without notice. Such modifications shall become effective immediately upon the posting thereof on Refractory’s website. Therefore, Buyer should review Refractory’s policies, terms and conditions each time Buyer visits the website. The most current version of these Terms and Conditions can be found on Refractory’s website.


Copyright

The design of each product designed and/or manufactured by Refractory is proprietary to Refractory and protected by U.S. Copyright Laws,, 17 U.S.C. 101 et seq. Unauthorized copy of our designs, products, sales materials, publications, etc. constitutes infringement of our copyrights, infringement of our trade dress, misrepresentations as to source or origin, and unfair competition, all in violation of U.S. Copyright Laws, 15 U.S.C. 1051, et seq.


All website images are property of and copyrighted by Refractory, and others from whom it has permission to share, and should not be saved, copied, sold or redistributed without express permission of Refractory.


Controlling Law

This agreement shall be deemed to have been executed and delivered at Refractory, 4201 W Wrightwood Avenue, Chicago, Illinois 60639. This agreement and all rights and obligations hereunder, including matters of construction, validity and performance shall be governed by the laws of the state of Illinois including the Uniform Commercial Code as enacted in that jurisdiction, without giving effect to the principles of conflicts of law thereof. Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitrator shall award reasonable attorney’s fees and costs (including but not limited to all administrative fees and fees paid to the arbitrator) to the prevailing party.

The Refractory Studio website and all intellectual property rights included in or related to the Refractory Studio website (including but not limited to copyrights, trademarks, service marks, trade dress rights, domain name rights, patents and data rights), are owned or licensed by us, and all right, title and interest in the Refractory Studio website and the intellectual property rights remain our property. Please note that pictures of Refractory Studio products on the Refractory Studio website are not in the public domain and you are not permitted to copy, download, modify or redistribute or redisplay these images without our prior written consent.
